Rowell Auctions, Inc. has the sole authority to resolve any bidding disputes as they may arise.



<b>Auction End Times:</b> All Rowell Auctions, Inc. Online Only Real Estate Auctions are real time events and subject to extended bidding due to bidding activity. Rowell Auctions, Inc. reserves the right to adjust the auto extension time period.



<b>Example:</b> Rowell Auctions, Inc. Online Only Real Estate Auctions have an auto extend feature. Any bid placed within 10 minutes of the auction ending will automatically extend the auction for 10 minutes from the time the bid is placed. Example: If an auction scheduled to end at 2:00 p.m. receives a bid at 1:59 p.m., the close time of the auction automatically extends to 2:09 p.m. The auto-extend feature remains active until no further bids are received on the property within the 10 minute time frame. <b>Terms:</b> Within 24 hours after the close of the auction, winning bidders will be emailed a contract package to be executed and returned to Rowell Auctions, Inc. within 24 hours of receipt of contract package from Rowell Auctions, Inc. Successful bidders will deposit $5,000.00 or 10% of contract price, whichever is more in the form of cashier's check or wire transfer to Rowell Auctions, Inc. The entirety of the remaining balance is due at closing. Purchaser shall be responsible for all wire transfer fees.

Buyer's Premium: A 10% buyer’s premium will be added to the bid price to determine the final contract price.



10% Buyer's Premium Example:

Bid Price: $1,000,000

Plus 10% Buyer's Premium: $100,000

Total Contract Price: $1,100,000



<b>Contracts:</b> Contract Documents will be sent to winning bidders within 24 hours of the conclusion of the auction by e-mail. Bidder must execute and fax or email the contract to Rowell Auctions Inc. within 24 hours of receipt of the contract package. Successful bidders not executing and returning their contract within 24 hours of receipt of the contract package will be considered in default.



<b>Auction Administrative Fee:</b> In the event a winning bidder fails to submit the signed 'Contract for Sale of Real Property' and deposit earnest money as provided in the prestipulated Auction Terms, the winning bidder will be charged an administrative fee of $2,500.00 on the credit card provided at auction registration. Additional default remedies are reserved by Rowell Auctions, Inc. and the Seller as provided in the Auction Terms & Conditions and the 'Contract for Sale of Real Property'. All administrative fees are non refundable.



<b>Closing:</b> Time being of the essence, these sales shall be closed on or before December 28, 2012. The purchaser will pay for all closing costs associated with the transaction. The 2012 ad valorem taxes will be prorated between purchaser and seller at closing.



<b>Broker Participation:</b> A two percent (2%) bid price commission is available to properly registered brokers. A Broker Participation Form with complete instructions is available at www.rowellauctions.com.

Rowell Auctions, Inc. reserves the right to remove or cancel the bids and or bidding rights and privileges of any party, deemed not to be in the best interest of the seller, at any time. If the 14± Acres, located on US 319 South sells divided, a boundary survey will be made by Southern Surveying Services, 5 Southwest Railroad Street Hazlehurst, GA 31539, (912) 375-9200, a land surveyor registered in the State of Georgia to perform a boundary survey of the Property in accordance with the minimum technical requirements for the State of Georgia and certified in favor of Purchaser and Seller. The Survey shall be subject to Seller’s approval. The surveyor will charge 32 cents per linear foot on all exterior lines and 16 cents per linear foot on all common lines between auction purchasers of adjoining parcels. The final purchase price shall be determined by multiplying the contract price per acre by the number of surveyed acres rounded to the nearest one-thousandth of an acre. Division stakes are intended for approximation use only. Actual boundary lines are to be determined by boundary field survey and may vary from field markers. It is understood that the acreage and dimensions of the tracts may vary according to actual survey. All Survey expenses will be paid by the Purchaser For this fee, the surveyor will mark all property corners and provide the Purchaser with a recordable plat. This fee does not include the actual openings of the lines. The surveyor will open lines for an additional fee. As used herein, the term “surveyed acreage” means the total gross acreage of the Property without any deduction for any portion thereof located within the bounds of any roadways (except deeded roadways), easements or other rights of way, including, without limitation, electric transmission lines or other utility easements. <b>CLOSING</b>

These sales will be closed by Lester Castellow with Moore, Tyndal, and Castellow, 700 South Main Street, Moultrie, GA 31768, (229) 985-1213, [email protected] The closing attorney will charge the purchaser $450.00 per real estate transaction. The closing fee includes conducting the closing, collecting and disbursing funds at closing, and preparing a closing statement. If the Purchaser(s) needs additional services,

they will be provided at a reasonable fee. The seller will pay for preparation of the deed only. Any additional closing fees including, but not limited to, recording, transfer tax/documentary stamps, financing expenses, intangible taxes, title fees, title insurance, appraisals and inspection reports, will be the purchaser’s expenses. All items sell “as is, where is” with no guarantees or warranties express or implied. All purchases are considered verified by the purchaser as to grade and authenticity. The purchaser will rely solely on his/her judgment in any purchase.



<b>Payment:</b> The successful Purchaser(s) will make payment in full at the close of the auction in the form of cash, cashier’s check, credit card, money order or wire transfer. A 10% Buyer’s Premium will be added to the bid price to obtain the contract price. Sales tax of 7% will be charged on all applicable purchases.



Dealers buying for resale may be exempt from paying sales tax if the dealer provides their sale tax resale number and executes the sale tax exemption form.

<b>TERMS FOR FIREARMS</b>



All firearms sales are subject to Federal Firearms Regulations. Purchasers will be required to complete all necessary forms in order to facilitate firearm transfers. Firearms will be transferred by Denver Braswell of Moultrie Shooter Supply (a licensed FFL dealer) for a fee of $25.00 per firearm. All firearms sales will be subject to purchaser’s criminal background check. Purchasers with a Federal Firearms License or current Georgia Firearms License are exempt from background checks. Certified copies of documents must be presented at pickup.



<b>PICKUP OF FIREARMS</b>

All firearms must be picked up at Moultrie Shooters Supply, 130 Woodman Road, Moultrie, Georgia 31768, (229) 890-7383 between regular business hours. Firearms not picked up by December 11th, 2012 are subject to a $10.00 per day storage fee. Purchasers are required to have a paid invoice for purchase and copies of Federal Firearms License or Georgia Firearms License (handgun permit). All firearms not picked up in person will be shipped by FFL dealer to FFL dealer via UPS. Charges for shipping and handling are $40 per gun. FEES DO NOT INCLUDE INSURANCE.
