Broker Participation: A three percent (3%) bid price commission is available to properly registered brokers. A Broker Participation Form with complete instructions is available at www.rowellauctions.com (REGISTRATION REQUIRED)
Possession: Possession of the real estate will be granted to the Purchaser at closing.
Contract For Sale Of Real Property:

Please read and review the contract thoroughly prior to bidding on any property. If you have not read and reviewed the Contract for Sale of Real Property, Do Not Bid!
Representation: Purchaser and Seller acknowledge and agree that the only auctioneer/broker involved in this transaction is Rowell Auctions, Inc. and has acted as agent for the Seller in this transaction. Rowell Auctions, Inc. has not acted as agent in this transaction for the Purchaser.
Terms of Real Estate: The successful Purchaser(s) will deposit $10,000.00 for cash purchasers and $2,500.00 for those pre-qualified for financing as earnest money at the auction in the form of cash, cashier’s check or good personal funds accompanied by a bank letter of guarantee, sign a real estate sales contract and pay the balance at closing on or before July 23, 2012. A 10% Buyer’s Premium will be added to the bid price to obtain the contract price.
Closing: This sale will be closed by John Carlton, Whelchel and Carlton, LLP, 26 2nd Ave. SW, Moultrie, GA 31776, (229) 985-1590 . The closing attorney will charge the purchaser $400.00 per real estate transaction. The closing fee includes conducting the closing, collecting and disbursing funds at closing, and preparing a closing statement. If the Purchaser(s) needs additional services, they will be provided at a reasonable fee. The seller will pay for preparation of the deed only. Any additional closing fees including, but not limited to, recording, transfer tax/documentary stamps, financing expenses, intangible taxes, title fees, title insurance, appraisals and inspection reports, will be the purchaser’s expenses. With regard to bank wire fees for receiving or sending purchaser’s earnest money deposits, the purchaser will be responsible for any bank fees associated with such.

All items sell “as is, where is” with no guarantees or warranties express or implied. All purchases are considered verified by the purchaser as to grade and authenticity. The purchaser will rely solely on his/her judgment in any purchase.
Payment: The successful Purchaser(s) will make payment in full at the close of the auction in the form of cash, cashier’s check, credit card, money order or wire transfer. A 10% Buyer’s Premium will be added to the bid price to obtain the contract price. Sales tax of 7% will be charged on all applicable purchases.
Dealers buying for resale may be exempt from paying sales tax if the dealer provides their sale tax resale number and executes the sale tax exemption form.
Possession of the personal property will be granted upon final payment. NO EXCEPTIONS.
Buyer’s Premium: A 10% Buyer’s Premium will be added to the bid price to determine the final sales price.

Bid Price: $10,000.00
Plus 10% Buyer’s Premium: $1,000.00

TERMS FOR FIREARMS
All firearms sales are subject to Federal Firearms Regulations. Purchasers will be required to complete all necessary forms in order to facilitate firearm transfers. Firearms will be transferred by Denver Braswell of Moultrie Shooter Supply (a licensed FFL dealer) for a fee of $25.00 per firearm. All firearms sales will be subject to purchaser’s criminal background check. Purchasers with a Federal Firearms License or current Georgia Firearms License are exempt from background checks. Certified copies of documents must be presented at pickup.
PICKUP OF FIREARMS
All firearms must be picked up at Moultrie Shooters Supply, 130 Woodman Road, Moultrie, Georgia 31768, (229) 890-7383 between June 26, 2012 and June 30, 2012, Tuesday through Friday from 9:00 a.m. until 6:00 p.m. and Saturday 9:00 am until 3:00 pm. Firearms not picked up June 30, 2012 by are subject to a $10.00 per day storage fee. Purchasers are required to have a paid invoice for purchase and copies of Federal Firearms License or Georgia Firearms License (handgun permit). All firearms not picked up in person will be shipped by FFL dealer to FFL dealer via UPS. Charges for shipping and handling are $40 per gun. FEES DO NOT INCLUDE INSURANCE.

NO FIREARMS WILL BE SOLD TO BIDDERS NOT COMPLYING WITH THESE REQUIREMENTS. ALL OUT OF STATE PURCHASES OF HANDGUNS MUST TRANSFER
TO A LICENSED DEALER IN THEIR RESPECTIVE STATE. SHIPPING AND ADDITIONAL CHARGES WILL BE THE RESPONSIBILITY OF THE PURCHASER.

ANY BIDDER DESIRING TO HAVE FIREARMS PURCHASED AND TRANSFERRED TO A LICENSED FFL HOLDER MUST COMPLY WITH ONE OF THE FOLLOWING:
1) BE THE HOLDER OF THE FFL. BRING A SIGNED COPY OF THE FFL WITH YOU AND PICTURE ID IDENTIFYING YOU AS THE PERSON LISTED ON THE FFL.
2) HAVE A NOTARIZED LETTER ON THE FFL DEALER’S LETTERHEAD WITH THE FOLLOWING STATEMENT:

MY SIGNATURE BELOW CERTIFIES THAT I AM AUTHORIZED UNDER THE BATF REGULATION TO SIGN FFLS FOR THIS BUSINESS AND TO AUTHORIZE THIS TRANSACTION.
